第100号法令:燃气火电项目新机制

序言

2025年5月8日,越南政府颁布了第100/2025/ND-CP号法令(以下简称“第100号法令”),修订了2025年3月3日颁布的第56/2025/ND-CP号法令(以下简称“第56号法令”)。第56号法令旨在落实《电力法》的规定,包括与电力发展规划、电网建设、电力项目投资以及电力商业项目投资者选择竞争性招标相关的规定。如需了解更多关于第56号法令主要内容的信息,请参阅我们2025年3月发布的法律动态,题为”颁布第56号法令,落实2024年《电力法》:电力发展规划和投资者选择“。

第100号令修订了第56号令第十五条,引入了促进燃气火电项目发展的机制。第100号令自发布之日起生效。

100号法令的主要特点

第100号令将第56号令第十五条的标题从“燃料价格转为电价原则、燃气火电项目长期最低合同发电量”更新为“促进国产天然气消费的机制、燃料价格转为电价原则、燃气火电项目长期最低合同发电量”。

这体现了政府对推进燃气和液化天然气(“LNG”)电力开发的重视。 

使用国天然气的燃气发电项目机制

  1. 动员使用国产天然气的项目将根据天然气供应情况,在满足燃料、容量和输出要求,并符合国家电力系统需求和技术限制的前提下,以最大容量运行。
  1. 适用范适用于2036年1月1日前经国家批准竣工并使用国产天然气发电的项目。该机制持续有效,直至项目停止使用国产天然气。
  1. 燃料短缺:如果国产天然气供应不足,电力买卖双方将根据现行规定,在购电协议中协商燃料使用情况和电价。 

使用口液化天然气的燃气发电项目机制

  1. 合同框架:电力买卖双方商定长期最低合同发电量,以确保:
    • 在本息偿还期内,发电量至少达到项目多年平均年发电量的65%,自发电开始之日起最长10年;
    • 根据适用法规协商的期后产量或费率;及
    • 根据工业和贸易部(“MOIT”)关于定价和购电协议的规定计算的多年平均产量。
  1. 适用范适用于2031年1月1日前经国家批准竣工并使用进口液化天然气发电的项目。 

利益相关者的责任

第100号法令修订了第56号法令,规定了以下利益相关方的责任,以符合上述使用国产天然气和进口液化天然气的燃气发电项目机制(“机制”):

  1. 买卖双方:协商符合机制和相关法律的购电协议。
  1. 国家力系统调度和力市交易位:规划和管理电力系统运营和竞争性市场交易,确保遵守机制以及MOIT关于市场和调度运营的规定。

第100号法令建立了有针对性的机制,以支持使用国内天然气和进口液化天然气的燃气火电项目。通过优考虑调度和确保长期合同产出,这些规定增强了投资确定性,并促进了燃气发电有效整合到越南的能源结构中。
