新加坡知识产权局就人工神经网络的可专利性征求反馈

利用人工神经网络和深度学习技术进行的发明创造和科学发现的数量正在迅速增长,涉及这些技术的专利申请数量也稳步上升。然而,人工神经网络面临着重大的可专利性问题。

在英国最高法院最近审理的 Emotional Perception AI Limited(上诉人)诉英国专利、外观设计和商标局局长(被上诉人)[2026] UKSC 3 一案(简称“Emotional Perception 案”)中,法院裁定,只要涉及人工神经网络的发明具有技术特征,即具有可专利性。该裁定提出了与新加坡专利实践的发展息息相关、涉及可专利标的和创造性步骤相关的值得关注的问题。

因此,新加坡知识产权局邀请知识产权从业人员分享他们关于该裁定对新加坡专利制度的意义和潜在影响的见解和观点,这将有助于为未来的讨论和政策制定提供参考。
